1. Scope and Purpose of the General Conditions of the Store

These General Conditions are intended, together with the order form and other elements referred to therein, to regulate the terms and conditions governing the provision of the Service through the Online Store. www.lighitbe.pt by Marina Manuela Rocha Ribeiro da Luz under taxpayer number 197380085. Light It Be is a registered trademark, headquartered at CCI 3407 – Arraiados, 2955-348 Pinhal Novo, domiciled at Centro de Empresas Maquijig, Zona Industrial das Carrascas, EN252 , 2950-402 Palmela.

The Service consists, through the address www.lightitbe.pt, of providing access to our Online Store, where we provide detailed information about each of our items, and allow the User, electronically, to order the products disclosed therein, in the terms and conditions described herein.

The order of Light It Be products must be placed by Users aged 18 (eighteen) years or older or, if younger, by Users who have authorization from their legal representatives. The User, by affirming that he has read and accepted the Terms and Conditions, confirms that he is 18 (eighteen) years old or older, or that he has authorization from his legal representatives to proceed with the acquisition. For data verification, Light It Be may contact the User.

The elements and information transmitted by the User will enjoy full legal effects, the User recognizing electronic purchases, and the User cannot claim the lack of signature for non-compliance with the obligations assumed. 

2. Product Information and Contents

Light It Be guarantees that the products displayed in our virtual showcase, each with its own name and description, correspond to the actual items for delivery. If you purchase a product that has characteristics different from those presented online, you have the right to terminate the purchase contract under the applicable legal terms.

All information about our products, respective prices, specifications, promotional actions and services may be changed at any time by Light It Be.

3. Responsibilities

3.1. All products sold at the Light It Be Online Store are in accordance with Portuguese law. 

3.2. The Light It Be Online Store has adequate levels of security, however, it will not be responsible for any damages suffered by the User and/or by third parties, due to delays, interruptions, errors and suspensions of communications that originate from factors beyond its control. , namely, any deficiencies or failures caused by the communications network or communications services provided by third parties, by the computer system, by the modems, fur connection or possible computer viruses or resulting from the download (download) through the service of infected files, or containing viruses or other properties that may affect the User's equipment. 3.3. Data and information queries carried out within the scope of this Service are presumed to be carried out by the User, and Light It Be declines any responsibility resulting from the abusive or fraudulent use of the information obtained.

3.4. Light It Be will not be responsible for any loss or damage caused by abusive use of the Service, which is not directly attributable to it as a result of fraud or gross negligence.

3.5. Light It Be is not responsible for losses or damages resulting from non-compliance or defective performance of the Service, when this is not directly or indirectly attributable to it by way of fraud or serious negligence, not being liable in particular:
i) For errors, omissions or other inaccuracies regarding the information made available through the Service;
ii) For damages caused by the fault of the User or third parties, including violations of intellectual property;
iii) For non-compliance or defective compliance resulting from compliance with judicial decisions or administrative authorities;
iv) For non-compliance or defective compliance that results from the occurrence of force majeure situations, such as situations of an extraordinary or unpredictable nature, external to Light It Be and that cannot be controlled by it, such as fires, power cuts, explosions, wars, riots, civil insurrections, government decisions, strikes, earthquakes, floods or other natural cataclysms or other situations beyond the control of Light It Be, which prevent or jeopardize the fulfillment of the assumed obligations.

3.6. Light It Be does not warrant that:
i) The Service is provided uninterruptedly, is safe, without errors or works infinitely;
ii) The quality of any product, service, information or any other material purchased or obtained through the Service meets any expectations of the User in relation to it;
iii) Any material obtained in any way through the use of the Service is used at the User's own risk and expense, this being the only
responsible for any damage caused to your computer system and equipment or for any loss of data resulting from such operation;
iv) no advice or information, whether oral or written, obtained by the User from or through the Service will create any guarantee that is not expressed in these General Conditions.

3.7. The User accepts that Light It Be cannot, in any way, be held liable for any damages, including, but not limited to, damages for loss of profits, data, contents, or any other losses (even if it has been previously notified by User about the possibility of occurrence of such damages), resulting from:
i) The use or impossibility of using the Service;
ii) The difficulty of obtaining any substitute for goods / services;
iii) Unauthorized access or modification to personal databases.

4. Consumer Obligations

4.1. The user undertakes to:
i) Provide correct personal data and addresses;
ii) Do not use false identities;
iii) Respect the order limits imposed. 

4.2. If any of the data provided is incorrect or insufficient, and for that reason there is delay or impossibility in processing the order, or eventual non-delivery, the responsibility lies with the User, and Light It Be declines any responsibility. In case the consumer violates any of these obligations, Light It Be reserves the right to eliminate future
purchases, block access to the store, cancel the supply of any other services made available simultaneously by Light It Be to the same User; and, furthermore, not allowing the User to access any or all services provided by Light It Be in the future.

5. Privacy and Protection of Personal Data

5.1. The website www.lightitbe.pt is a secure website, and Light It Be guarantees the confidentiality of all data provided by Users.

5.2. Personal data, identified on the order form as being mandatory, are essential for the provision of the Service by Light It Be. The omission or inaccuracy of the data provided by the User is their sole and entire responsibility and may give rise to refusal to provide the Service by Light It Be.

5.3. The User's personal data will be processed and stored by computer and are intended to be used by Light It Be within the scope of the contractual and/or commercial relationship with the User, and will only be used for another purpose if the User gives their express authorization.

5.4. Under the terms of the applicable legislation, the User is guaranteed, without additional charges, the right to access, rectify and update their personal data, directly or upon written request, as well as the right to oppose their use for the purposes set out in previous number, and for this purpose, contact the entity responsible for the processing of personal data.

5.5. The User can ask Light It Be for all the information it holds about him, and what use it will be. To do so, you must send an email to geral@lighitbe.pt  referring to the intended. 

5.6. The Internet is an open network, whereby the User's personal data, other personal information and all content hosted on the Service may circulate on the network without security conditions, even running the risk of being accessible and used by unauthorized third parties for the effect, and Light It Be cannot be held responsible for such access and/or use.

5.7. Light It Be undertakes to inform the competent authorities in the event of any attack that jeopardizes the confidentiality of User data on the website www.lightitbe.pt.

6. Cancellation of orders

6.1 At the request of the User The User may cancel his order by requesting it to Light It Be via email geral@lighitbe.pt , referring to the order number, which will be accepted as long as it has not yet been processed. After processing, Light It Be will try to deliver it, but the User has the option of not accepting it.

For the purpose of cancellation, the User must indicate the following data to Light It Be:
– Order number
– NIF with which you placed the order
- Delivery adress 

6.2. By decision of Light It Be

Light It Be reserves the right not to process orders whenever it finds any inconsistency in the personal data presented or observes misconduct on the part of the buyer. Light It Be reserves the right not to process any order or reimbursement, in the event that errors are found in the values ​​and/or characteristics of the products, when these result from technical problems or errors beyond Light It Be's control.

7. Return (Right of Resolution)

7.1. The User, not being completely satisfied with the Light It Be product that he has purchased, has a period of 14 days, counting from the day on which he acquires physical possession of the good, to make the return, provided that the products to be returned do not have been damaged through the User's use and handling.

To exercise this right, the User must communicate the intention and reason by sending an email to geral@lightitbe.p indicating the order data and your personal data.

The package must be returned complete, as it was delivered and accompanied by all the documentation received, namely the
following documents: sales invoice and the document proving receipt of the product. The package and documents indicated must be delivered to the following address:

7.4. The User must, within a period of 15 (fifteen) days from the date on which he has communicated his decision to return, return the product to Light It Be

7.5. Upon receipt of the return, Light It Be verifies that the returned product(s) complies with the following requirements:
a) They do not show damage (scratches, dents, any damaged components and continue to fulfill their good functionality);
b) They are properly packaged;
c) Contain all the items that accompany them. 

7.6. Users who send products to Light It Be without meeting any of the requirements in the previous point may not be entitled to a refund. The User will be contacted and will be offered a return, with the costs to be borne by the User.

7.7. The refund method depends on the payment method used for the respective order. In the case of payments with PayPal or credit card, these are credited to the respective account. In other cases, the return is made by bank transfer. There is also the possibility for the customer to opt for credit at the www.lightitbe.pt store. In that case, you will be given a Gift Card with the credit amount, so that you can use it in a next purchase.

7.8. The refund is made within a maximum period of 15 (fifteen) days, counting from the moment the return is received by Light It Be, provided that the brand already has the necessary data to proceed with the refund.
Receipt of the return will be communicated to the User by email. 

7.9. The expense related to shipping costs will be reimbursed to the User, if the item is returned due to a manufacturing defect or error in order processing.  

8. Production defect

8.1. In the event of a “production defect”, that is, when defects or characteristics are detected in the products ordered that make it impossible to use them for which they were intended, the User must inform Ligh It Be about the situation via email geral@lighitbe.pt
and return the product, together with a copy of the invoice, within a maximum period of 15 consecutive days from the invoice date, to the address

8.2. In order for the product to be exchanged, the User must ensure that the packaging is complete, containing all the components that constitute it, and in excellent condition.

8.3. In the absence of any of the elements mentioned above, or if any of the components are not in excellent condition, there will be no exchange, and the product will be returned to the User again.

8.4. In these situations, all logistical costs related to the return and exchange will be borne by Light It Be, except when the User opts for a different and more expensive delivery method than the commonly accepted and less expensive method proposed by Light It Be.

9. Deliveries

Light It Be will always do everything in its power to ensure that your order is delivered as soon as possible. The number of days expected for the delivery of orders is calculated from the date of shipment and not from the registration date.

The value of the shipping costs will be indicated during the checkout.

As a rule, orders are processed on the business day following the payment confirmation day.

Delivery is made from Monday to Friday – except on local or national holidays – and it is not possible to make an appointment for delivery.
The customer must provide an address where he will be present between 9am and 19pm, to ensure efficient delivery.

Whenever the delivery address provided by the customer is incorrect or incomplete, Light It Be may have to be returned, causing additional costs for the customer.

In situations where the orders are not delivered to the customer due to the unequivocal responsibility of the freight forwarder, we suggest that the customer send us a complaint, which will be forwarded to the freight forwarder for analysis. The final solution that Light It Be will present will depend on the response given by the freight forwarder. If the latter assumes responsibility, the logistical costs, meanwhile borne by the customer,
will be refunded to you.

10. Payments

The customer can choose to pay via Multibanco Reference (only available in Portugal), MBWay (only available in Portugal), Credit Card (Visa, MasterCard) and Paypal

The customer will have a period of 3 (three) calendar days, starting from the date on which he placed his order, to make the payment. The order will not be considered accepted until it is effectively confirmed that payment has been received. After the indicated period, if Light It Be has not received the corresponding amount, the order will be cancelled.

11. Intellectual property

11.1. Our Online Store is a registered website and the Service provided by the website itself is the responsibility of Light It Be.

11.2. The User acknowledges that the Service contains confidential information and is protected by copyright and related rights, industrial property and other applicable legislation.

11.3. The User acknowledges that any content appearing in advertising, highlighting, promotion or mention of any sponsor or
The advertiser is protected by laws relating to copyright and related rights, by laws relating to industrial property and other property protection laws, so that any use of these contents can only take place under the express authorization of the respective owners.

11.4. The User undertakes to fully respect the rights referred to in the previous number, namely refraining from performing any acts that may violate the law or said rights, such as reproduction, commercialization, transmission or placement making such contents available to the public or any other unauthorized acts that have as their object the
same contents.

12. Service security conditions

12.1. The User undertakes to observe all applicable legal provisions, namely, not to practice or encourage the practice of illegal acts or offensive to good customs, such as the indiscriminate sending of unsolicited communications (spam), in violation of the provisions of the legislation applicable to the processing of personal data and advertising communications through automatic call devices, and must also observe the rules for using the Service, under penalty of Light It Be suspending or deactivating the Service in the foreseen terms at point 13.

12.2. The User expressly acknowledges and accepts that the IP Network constitutes a public electronic communications network that can be used by several users and, as such, is subject to computer overloads, for which reason Light It Be does not guarantee the provision of the Service without interruptions, loss of information or delays.

12.3. Light It Be also does not guarantee the provision of the Service in situations of unforeseeable overload of the systems on which it is supported or of force majeure - situations of an extraordinary or unforeseeable nature, external to Light It Be and which cannot be controlled.

12.4. In the event of interruption in the provision of the Service due to unpredictable overload of the systems on which it is supported, Light It Be undertakes to regularize its operation as soon as possible.

13. Suspension and deactivation of the Store Service

13.1. Regardless of any prior or subsequent communication, Light It Be may, at any time, and in accordance with its sole discretion, discontinue providing the Service and/or part of the Service to one or all Users. 

13.2. Light It Be also reserves the right to immediately suspend or terminate access to the Service when the User does not observe the conditions of use referred to in point 4 and others referred to in the General Conditions;

13.3. The suspension or termination of the Service by Light It Be, under the terms of the previous numbers, regardless of the right of the User or third parties to any compensation or other compensation, Light It Be cannot be held responsible or in any way encumbered, for any consequence resulting from the suspension, annulment or cancellation of the Service.

13.4. In the situations described above, Light It Be will notify the User – in advance, so that the latter, if they wish, can safeguard the content of their order viewing area – within a period of 3 (three) working days, counting from the sending of the e- mail or availability of information on the main page of the Service. 

14. Communications

14.1. Without prejudice to other forms of communication provided for in these General Conditions, notifications made to the User that relate to the Service, including any changes to these General Conditions, may be made to the User's email address, by SMS or telephone contact. .

14.2. The User agrees to receive any and all communications and/or notifications related to their orders, to the address, contact telephone number and/or email address (e-mail) indicated in the ordering process.

14.3. Light It Be will only send additional information related to Campaigns, Launches or Promotions if the User explicitly mentions that he wants to receive this information, subscribing to the Newsletter through the appropriate forms.

14.4. At any time, the User may express their wish to stop receiving these communications and/or notifications via email, or the link “Do not receive the Newsletter” (or similar) inscribed in each Newsletter.

15. Technical Settings

15.1. Without prejudice to the provisions of the following number, Light It Be may change the Service and/or the technical conditions for providing the same, as well as the respective rules of use, and shall disclose such changes to the User at least 15 (fifteen) days in advance. days.

16. Changes

16.1. Whenever Light It Be deems it necessary or convenient to optimize the browsing experience and/or improve connectivity conditions, it may remotely reformulate the network settings. 

16.2. Without prejudice to the provisions of the following numbers, and given the innovative nature of the Service and the technological evolutions to which it may be subject, Light It Be may change its technical configurations, whenever this proves to be convenient, in order to adapt it to eventual optimizations. or technological developments.

16.3. Light It Be, however, does not guarantee the User the performance of any upgrades or improvements in
Service.

16.4. Some upgrades or new features of the Service may only be available against payment by the User and/or subscription, by the same, of Specific Conditions of use.

17. Complaints

17.1. The User may submit any contractual conflicts, to arbitration and mediation mechanisms that are or may be legally constituted, as well as complain to Light It Be about acts and omissions that violate the legal provisions applicable to the acquisition of goods.

17.2. The complaint must be presented within a maximum period of 30 (thirty) days, counted from the knowledge of the facts by the User, being registered in the information systems of Light It Be, which must decide the complaint and notify the interested party, within a maximum period of 30 (thirty) days from the date of receipt.

18. Applicable law

The Contract is governed by Portuguese law.
